Meeting Minutes
May 5, 2008
The regular monthly meeting
of the Hulmeville Borough Council was held on the above date at the Borough
Hall, 114 Trenton Avenue.
Councilmember’s Present:
Thomas Wheeler; President, Raymond Johnson; Vice President, Debbie
Mahon, Daniel Mandolesi, Joe McKairnes and Edward Preston.
Councilmember’s Absent: Frank
Lewis.
Others in attendance: Mayor
Dave Harris, Solicitor Robert DeBias, Police Chief Tom Walton, Treasurer

Call to Order: Mr.
Wheeler called the meeting to order at 7:30 p.m.; all those present joined
in the Pledge of Allegiance.
Minutes: Motion to approve the
minutes of April 7 and April 15, 2008 made Mr. Preston seconded by Mrs.
Mahon with the following correction noted by Mayor Harris: April 7, 2008
correction to the minutes of March 18, 2008 minutes should read, “…that the
Boro should continue to pursue dialogue.” Mr. Wheeler also noted that Joe
Bound was present at the April 7th meeting not Don Bound. Minutes approved 6-0-0.
Police Report: Mr.
Johnson reviewed the Police Report of April 2008: 25 Incidents, 78 Traffic Citations, 6
Parking Tickets, 0 Accident, 7 Assist Calls, 0 Summary, 4 Criminal, 31
District Court appearances and 2 County Court appearances; total hours
worked 153, for a combined salary of $3465.38. Mrs. Mahon questioned Chief Walton as to
whether there have been any repercussions with respect to the recent news
article relating to the request made by District Court Judge Baranoski for
the department to change procedures when processing DUI (driving under the
influence) cases. According to Chief
Walton, the only note worthy follow up request for information that he
received was raised by the Bucks County District Attorneys office where
they asked for assurances that the officers were not allowing the motorist
to further operate their vehicles immediately after the charges were
made. Mr. Preston questioned another
news article which referenced an officer being cited on harassment charges;
Chief Walton noted that the matter is a personal issue and does not effect
the department.
Police/ Regionalization: After some discussion, a
motion was made by Mr. Johnson seconded by Mr. McKairnes to delay sending the
Letter of Intent to the Department of Economic & Community Development
relative to regionalization of the borough police department. The decision was made to postpone sending
the letter until all councilmember’s are present to vote on the matter. Motion approved 5-1-0; with Mr. Preston as
the no vote.
Zoning Officer: Mr. Buchhofer
reviewed the permits issued for the month of April.
The Uptown String Band has
expressed an interest in building a practice and storage facility on their
property at 115 Trenton Ave. (tax map parcel#16-1-78). Several questions relating to parking and
noise concerns were raised by members of Council; Mrs. Buchhofer will
follow up with the band representatives for clarification.
Public Comment: Debbie
Earnest raised concerns with the storm pipe under Main Street along Trenton
Ave. Mr. Wheeler informed Mrs.
Earnest that the Borough engineer has provided Council with three quotes to
repair the storm drain pipe and that repair to the road surface will
follow.
Borough Property: Mr.
Wheeler expects a School project schedule from Matt Piotroski within the
next few weeks.
Streets: Motion made by Mr.
McKairnes seconded by Mrs. Mahon to authorize the solicitor to prepare a
resolution with the intention to redistribute unused funds from the
Municipal Grant Program toward the Road Resurfacing Project and repairs to
the Main Street Storm Sewer Pipe.
Motion approved 6-0-0. Motion
to approve the expenditure to sweep the streets made by
Mr. Preston seconded by Mr.
McKairnes, 6-0-0.
Authority Report: Mrs.
Ingraham referenced a notice of rate increase from the Bucks County Water
& Sewer Authority dated April 29, 2008.
The Authority will meet to discuss the impact that the increase has
on the Borough.
Treasurer’s Report:
Treasurer’s Report of May 5, 2008 was made available for inspection.
Old Business: Mr.
Wheeler noted that the Postal Inspector has agreed to allow Mr. Kiss at
613 Main Street (tax map
parcel #16-5-54-3) to reposition his mailbox back along his driveway.
Mrs. Mahon questioned
whether Mr. Dave Preston- AMDK, (100 Reetz Ave.; tax map parcel #16-3-113)
has made the repairs to the driveway apron.
Mr. DeBias will send a letter to
Mr. Preston reminding him of
his obligation to make the repairs.
Motion to authorize
Mr. DeBias to send the
letter made by Mr. McKairnes, seconded by Mr. Johnson, 5-0-1,
Mr. Edward Preston
abstained.
New Business: Mr.
Preston noted the annual Hulmeville-Penndel Memorial Day Parade will be
held on Saturday May 23rd.
Mr. Wheeler noted that there have been sightings of rabid raccoons
along the Neshaminy Creek in the 500 block of Main Street. An arrangement has been made with Bucks
County to split the costs associated with the removal of the animals. Motion to approve the expenditure made by
Mr. Wheeler seconded by Mr. McKairnes, 6-0-0.
Mayor’s Report: Mayor
Harris performed three weddings for the month of April. He also attended an Emergency Management meeting. Mr. Harris requested the Zoning Officer
inspect Pastor’s Garage (tax map parcel #16-5-49) as the roof appears to be
in poor condition. Mayor Harris also
thanked Council for their support of the Boy Scout breakfast and noted that
the event raised $20,000.
Solicitor’s Report: Mr.
DeBias presented for review and approval Ordinance No. 244 which amends
Ordinance No. 223 relating to Snow and Ice Emergency and Increasing the
Fine for Violation of the Ordinance; motion to approve the ordinance made
by Mr. Preston seconded by Mr. Mandolesi, 6-0-0.
Communications: Letter
of April 26, 2008 from Dave Harris thanking Councilmember’s for their
support of the Scout breakfast.
Bills: A copy of the bill
list dated May 5, 2008 was provided to Councilmember’s and offered for
review by the public. Motion made by
Mr. McKairnes seconded by Mr. Mandolesi to approve the bill list, 6-0-0.
There being no further
business the meeting was adjourned at 9:35; motion made by
Mr. Mandolesi seconded by
Mr. McKairnes.

Work Session Meeting Minutes
The special work session
meeting of the Hulmeville Borough Council was held on the above date at the
Borough Hall, 114 Trenton Avenue.
Councilmember’s Present:
Thomas Wheeler; President, Raymond Johnson; Vice President, Frank
Lewis, Debbie Mahon, Dan Mandolesi, Joseph McKairnes and Edward
Preston.
Councilmember’s Absent: none
Others in attendance: Solicitor Robert DeBias and Secretary
Patricia Boyle.
Call to Order: Mr.
Wheeler called the meeting to order at 7:39 p.m.; all those present joined
in the Pledge of Allegiance.
Boro Property: Mr.
Wheeler, Mr. McKairnes and Mrs. Mahon recently met with Matt Piotroski
to discuss the architectural
plans for the School Building. Mr.
Piotroski will redraw the plans with the member’s recommendation for
changes.
Zoning: Mr. Wheeler noted that
a cease and desist order was issued to Tom McClave
of 10 Michele Court (tax parcel map
#16-1-8-4) as he was cutting down trees without a permit to do so. Curt Gerenda of 611 Main Street (tax
parcel map #16-5-54-2) was informed via written notification from the
Zoning Officer that he needs a certificate of occupancy before moving into
the residence. Pastor’s Garage (tax
parcel map #16-5-49) received written notification from the Zoning Officer
that the structure is inhabitable, as the roof is falling in on itself. Mr. Wheeler noted that Tom McClave of 10
Michele Ct. (tax parcel map #16-1-8-4) has failed to install the seepage
pits which were required as part of the building plan. Mrs. Buchhofer will make contact with Mr.
McClave and inform him that the Boro is prepared to take legal action as
well as rescind the temporary certificate of occupancy if the seepage pits
are not installed immediately. Mr.
DeBias’ letter of May 9, 2008 addressed to Mr. Dave Preston- AMDK, (100
Reetz Ave.; tax map parcel #16-3-113) in reference to the cracked sidewalk
apron was reviewed. Mr. Preston was
informed that he has until June 2008 to make the repairs.
Code: Mrs. Mahon will remind
residence of the lawn care/maintenance ordinance in the next Garden Club
newsletter. Mrs. Boyle and Mr.
McKairnes complained about the property at 400 Main Street (tax parcel map
#16-3-28) as the grass and weeds are overgrown; Mrs. Boyle will send the
property owner a letter informing them of the ordinance. Mrs. Mahon volunteered
to be the town Environmentalist; responsibilities include determining when
a tree should/ can be removed.
Streets: Mr. Lewis gave notice
that Reilly Sweeping would be cleaning the streets on May 22nd.
Solicitor’s Report: Mr.
DeBias advised that Mr.Feriod (tax parcel map #16-5-54-1) needs to send a
letter of extension for his minor subdivision request or the plans will be
denied at the June meting; Mr. Wheeler has notified Mr. Feriod. Mr. DeBias advised Council that Borough
Code prohibits Council from taking action or voting at Work Session
meetings. All voting must take place
at the General meetings. Mr. DeBias
suggested that Councilmembers begin to assemble lists of projects
applicable to the Municipal Grant Program as the applications will be
forwarded to the Borough in August.
Water & Sewer: Mr.
DeBias noted that the Authority has made their recommendations for the
sewer and water rate increases to coincide with the Bucks County Water
& Sewer Authority’s rate increases.
Mr. DeBias advised that there would not be adequate time for the
Boro to advertise the amended ordinance prior to the July billings. In addition, there were some questions
with respect to the rate recommendations which Mrs. Mahon will address with
the Authority.
Police Regionalization: There
was continued discussion and debate about regionalization and the Letter of
Intent. The matter will be revisited
at the June 2nd general meeting.
There being no further

seconded by Mr. Preston.
